Magistrate Calls for Nose Bite Footage

A MAGISTRATE has changed his stance on viewing footage of assault cases, adjourning a sentence so CCTV could be watched before deciding on a penalty.

Magistrate Rod Madsen also asked for more information on an assault victim's claim that he lost his job after being beaten and bitten in a McDonald's restaurant about 11pm on August 27 last year.

Mr Madsen made the request during the sentence of 31-year-old Hayden Campbell Bowie, who pleaded guilty in Maroochydore Magistrates Court yesterday to the drunken assault of a teenager at a Chincilla McDonald's restaurant.

Mr Madsen's decision when sentencing a different assault matter in October last year not to watch CCTV footage of the incident drew intense media attention and community reaction.

Metropolitan media and local TV news both ran stories criticising the magistrate for declining to watch the footage.

He said yesterday "much was said" of his failure to watch the footage on that occasion.

"I would like to see it," Mr Madsen said. …
