QMY GODMOTHER has decided to sell her house. She has owned the property for 31 years but it is not registered at the Land Registry. The buyer's solicitors are requesting that her solicitors register the house at the Land Registry before selling to their client. Why is this? AAS YOUR godmother's property is unregistered, it is her original deeds that prove she is the owner. Her solicitors will prepare an epitome of title, which is basically a list of these deeds.

They will send copies of all the documents listed on the epitome to the buyer's solicitors who should check them all to ensure that your godmother is indeed the owner and is entitled to sell to their client.

They should also check for any restrictive covenants, easements such as rights of way etc. Once the purchase has been completed they will receive from your godmother's solicitors the original deeds and will have to make an application to the Land Registry for first registration of title. If your godmother's title to the property was registered, her solicitors would obtain from the Land Registry an official copy of the Register of Title and Title Plan and send that to the buyer's solicitors. Checking such documents is likely to involve less work for the buyer's solicitors, as any relevant information should have already been extracted from the old deeds and entered on to the Register of Title when the property was first registered -- hence their request for your godmother's solicitors to undertake the first registration of title.
