JUDGE: POLICE ERRED

A federal judge has ruled that three Atlanta police officers had

no justifiable reason to make an investigatory stop outside the

Moto Cycles shop that left an unarmed man dead in December 1995.

The three officers, Ivant Fields, Waine Pinckney and Willie

Sauls, violated the constitutional rights of the four people in

a car driven by Jerry Jackson when their "illegal seizure"

resulted in a shootout, Senior U.S. District Judge Robert Vining

said in an order filed this week.

Two lawsuits, filed by Jackson's family and friends, are set

for trial next week.

Vining's ruling against the city means that all a federal jury

has to decide is how much the city must pay in damages. The

lawsuits do not specify an amount.

City officials said they plan to appeal.

The Moto Cycles shooting ignited intense criticism of the

Atlanta Police Department after witnesses claimed Jackson was

shot executionstyle. All three officers remain on the police

force.

MEDICAID OKS VIAGRA

Following a recent federal mandate, Georgia Medicaid officials

said this week they will begin in September to pay for Viagra,

the male impotence drug that has spawned an abundance of sales,

press and Jay Leno jokes.

On July 2, the U.S. Department of Health and Human Services

issued a directive ordering Medicaid, the health-care program

for poor people, to pay for Viagra prescriptions when it is

"medically necessary."

A bipartisan group in Congress is seeking to overturn that

directive.

The National Governors Association estimated that Medicaid

coverage for Viagra could cost taxpayers $100 million a year. …
