The St. Louis County Planning Commission has, in effect, rejected again a petition from Wells and Highway 21 Corp. to rezone 5.3 acres of land near Tesson Ferry Road and Highway 21 for commercial use.

The petition called for six businesses, including two 24-hour operations, to be located on the site. At this week's executive meeting, commissioners opposed the plan for two main reeasons:

They said that two 24-hour businesses, a Site Oil service station and a Denny's Restaurant, would generate too much traffic on the property.

They said that three businesses on the section of land bordering the Southmoor Greens subdivision was one too many.

The commission originally had expressed these objections at its Aug. 30 executive meeting, after hearing the petition for the first time Aug. 2. Rather than recommend outright denial of the petition, however, the commission voted at the Aug. 30 meeting to give Wells 30 days to revise the plan and resubmit it for consideration. Although Wells agreed to make minor revisions to the plan, it refused to withdraw its requests for six businesses on the site or to have two of them be open around the clock.

"We wanted him to come back with another plan and he didn't," said Chairman Doug Morgan.

By approving the Planning Department's recommendations and approving three requirements of its own, the commission in effect voted 7-2 to reject the plan, officials said. Opposing the planning recommendations were commission members Wayne Hilzinger and Maureen Ramshaw.

The three requirements added by the commission called for:

Limiting operating hours of businesses at the site to 7 a.m. to 10 p.m.

Zoning the tract for general retail or office use, which would prohibit the inclusion of a service station on the property, as the Wells company had wanted.

Requiring architectural review of buildings constructed on site. …
