POP THE CORKS!: Sandberg, Phoenix & von Gontard scored three wins last week for clients who were sued in high-stakes cases.

- Ken Bean and Kathy Pine successfully defended Dr. Eli Wolfson and Group Health Plan against a malpractice claim alleging that Wolfson erred when he induced labor in Mary Neighbors. Neighbors' child was born with severe mental retardation and cerebral palsy. She was seeking $10 million to $30 million from Wolfson and Group Health.

The case was complicated because Wolfson was in Israel and couldn't get to the courtroom of Circuit Judge Jack Koehr. They solved the problem by having Wolfson appear on a satellite feed arranged by FM Mobile Television at a cost of $40,000, well worth it considering what was at stake.

- John Sandberg won a malpractice case for St. Louis Children's Hospital in the courtroom of Circuit Judge James R. Dowd. Kirk and Laresta Pruitt had sued the hospital and its doctors alleging they had failed to promptly diagnose and treat bronchiolitis in their 6-week-old infant, who died. The Pruitts sought between $350,000 and $500,000.

- Finally, at the Federal Courthouse, Keith Phoenix successfully defended Sears Manufacturing Co. in a product liability/wrongful death case.

Juanita and Chris Hoehn had sued Sears Manufacturing, alleging it had designed a defective seat for a piece of heavy construction equipment. The plaintiffs, seeking $900,000, contended the seat broke and caused Robert Hoehn (Juanita's son, Chris' father) to sustain physical injuries that later resulted in his death.
