Tim G. Lee is a positive thinker. He has snagged the No. 1 spot on the Republican ticket in the primary election for county prosecutor, even though he won't know for weeks if he is qualified to run.

Lee has sued the county because of its requirement that a candidate for prosecutor must live in the county for three years before taking office. He says the provision in the charter contradicts a section in state law that sets the residency requirement at one year. Lee has lived in St. Charles since November 1992.

Warren County Circuit Judge Fred Rush has been assigned to hear the matter. Lee says attorneys plan to submit their arguments to Rush later this month. Meanwhile, filing for the prosecutor's job opened Feb. 22, and Lee has his name on the top line.

As of Monday, Lee had no opponents for the Republican spot in the primary election Aug. 2. Prosecuting Attorney Timothy A. Braun was the only candidate to have filed for the Democratic position on the ballot. …
