Good Samaritan Lawyer Files Suit against Person He Helped

Two years ago, Stephen Tillery, a lawyer in Belleville, helped rescue Crystal D. Foster of Cahokia when she was pinned between a house and a lurching runaway car. Now he's suing her for back injuries he says he suffered in the incident.

It may sound like the Good Samaritan turned mean, but it's what the law requires if Tillery is to have any hope of collecting insurance for his injuries, says his attorney, Amiel Cueto.

Foster, now 19, said: "I'm quite shocked. I guess you need to be careful whom you accept help from. Some people cause more trouble than good."

Foster said she found out about the suit Thursday. She said she had yet to receive official notice of the suit. She lives with her parents and studies computer science at an area college.

Tillery's insurance won't pay unless he first tries to collect from everyone else involved, Cueto explained. The suit also names the car's owners as defendants. It seeks unspecified damages of more than $15,000 - the amount required for a jury trial - from each.
