Appellate Court Upholds Ruling Requiring Discharge The armed forces' ban on homosexual conduct on or off duty was upheld Friday by a federal appeals court in San Francisco. The 2-1 decision was the third consecutive federal appeals court ruling upholding the government's "don't ask, don't tell" policy on gays in the armed forces. The 9th U.S. Circuit Court of Appeals rejected arguments by a discharged sailor that the policy is unconstitutional because it treats homosexuals and heterosexuals differently. Circuit Judge Pamela Rymer ruled that those reasons are not irrational or based merely on prejudice. She also cited the courts' traditional deference to military judgment. In a dissent, Circuit Judge Betty Fletcher said the policy of discharging homosexuals, but not heterosexuals, for private off-duty sexual conduct was discrimination based entirely on prejudice against homosexuals. AP BALANCED BUDGET Democrat Freshman To Join In Support For Amendment Newly elected Sen. Max Cleland, D-Ga., pledged Friday to support the balanced budget amendment to the Constitution. Cleland's vote would be the 65th for the measure, which needs a two-thirds majority to prevail, or 67 senators if all vote. Cleland said he would attempt to change the Republican-drafted proposal to protect Social Security and allow flexibility in events of economic emergencies but would vote for the amendment in any case.
