To: All Creditors of the Above-Captioned Debtor and Other Parties in Interest
PLEASE TAKE NOTICE, that the United States Bankruptcy Court for the Western District of Oklahoma (the "Bankruptcy Court") has entered an Order dated May 6, 1985 (the "Bar Order"), requiring any holder of a claim (as defined in paragraph 1 below) against Continental Drilling Company, Inc., debtor and debtor-in-possession (the "Debtor"), which arose (a) before July 12, 1984, or (b) on or after July 12, 1984 and before October 19, 1984, to file a proof of claim as hereinbelow described on or before June 14, 1985 (the "Bar Date").
1. As used herein, "claim" shall mean (a) right to payment, whether or not such right is reduced to judgment, liquidated, unliquidated, fixed, contingent, matured, unmatured, disputed, undisputed, legal, equitable, secured, or unsecured; or (b) right to an equitable remedy for breach of performance if such breach gives rise to a right of payment, whether or not such right to an equitable remedy is reduced to judgment, fixed, contingent, matured, unmatured, disputed, undisputed, secured, or unsecured.
2. All those who fail to file a proof of claim in accordance with paragraph 4 hereof on or before the Bar Date shall be forever barred from asserting a claim against the debtor and shall not, with respect to any such claim be treated as a creditor of the Debtor for purposes of voting and distribution, except that any holder of a claim (a) who has already filed a proof of claim in accordance with paragraph 4 hereof, or (b) whose claim has been listed in the schedule of liabilities that the Debtor filed with the Bankruptcy Court (the "Schedule") and is not so listed as disputed, contingent, or unliquidated, may, but need not file a proof of claim. …
