Pair Deny Guilt in Girl's Killing

Nine months have passed since 12-year-old Genesis Rincon was shot to death while riding her scooter to a holiday party, but for her family, the pain has not faded.

Her mother, Jenny Calderon, gasped and appeared to be overcome with emotion Monday as the two men recently indicted in the girl's death stepped into a courtroom. Later, her sister, Alexis, leaned against her mother for comfort.

The two men -- Jhymiere Moore, 20, and Jeffery Ellerbee, 21, both of Paterson -- pleaded not guilty to charges of murder and weapons offenses. They stood quietly beside their lawyers, who rejected a deal by Passaic County prosecutors offering 40-year prison terms in exchange for their guilty pleas.

Moore's attorney, Harley Breite, said after the brief arraignment that the deal was "not a real plea offer," because it amounted to a life sentence for his client. Attorney Matthew Cavaliere, who represents Ellerbee, said the 40-year offer was not surprising, but "it's not a real incentive for any of the defendants to roll up their sleeves and sign up for it."

The appearance in state Superior Court, Paterson, was interrupted twice by men in the gallery who were making noises -- one was escorted out by a court security officer, and the other was ordered out by Judge Christopher Kazlau.

Members of Genesis' family, who have attended all of the court proceedings, filled a row of the courtroom and sat silently through the arraignment, again wearing T-shirts dedicated to the girl's memory.

Genesis' father, Alexis Rincon, declined to comment afterward.

Genesis was shot July 5 on Rosa Parks Boulevard in Paterson as she and two other children took turns riding her scooter to a relative's house for a family gathering after making a run to a grocery store.

Authorities have said the children were not the intended targets but have not disclosed whom the alleged gunmen meant to shoot. …
