Video Turns Up in Teacher DWI Case

HACKENSACK -- Prosecutors handed over additional discovery material on Monday in a brief court proceeding for a Lodi High School teacher accused of driving while intoxicated last April and crashing into the rear of county police cruiser on Route 46, critically injuring an officer.

Assistant Bergen County Prosecutor Martin Delaney informed state Superior Court Judge Edward A. Jerejian and the defense attorney, Brian Neary, that prosecutors had obtained surveillance video of the defendant, Michael P. Ettz, from an establishment near the accident scene, and had extracted information from Ettz's cellphone.

Delaney said the video showed possible witnesses to the accident whom his office is hoping to identify. He added, however, that he did not expect their potential testimony to change the case. The source of the video was not publicly disclosed.

Ettz, 37, a math teacher and track coach, was indicted in August on a second-degree charge of aggravated assault and one count each of assault by auto while driving intoxicated and leaving the scene of an accident, both of which are third-degree crimes. …
