Decision Will Wait on Whether to Appeal Judge's Heartland Park Ruling

Petition drive organizer Chris Imming and his attorney, R.E. "Tuck" Duncan, will wait a few more days to decide whether to appeal a judge's ruling invalidating a petition seeking to force a public vote on the Topeka city government's planned purchase of Heartland Park Topeka.

"My client and I have not had an opportunity to meet to review a number of issues surrounding an appeal," Duncan said early Monday evening. "As you know, we have a few days before that decision has to be made."

Duncan said he and Imming also would monitor the city governing body's actions when it takes up the topic for discussion during its 6 p.m. meeting Tuesday in its chambers at 214 S.E. 8th.

Duncan said late last week he and Imming planned to announce Monday whether they would appeal the ruling Shawnee County District Judge Larry Hendricks issued Wednesday in favor of the city of Topeka and Jayhawk Racing LLC. Hendricks invalidated a petition submitted by Imming seeking to force a public vote on the purchase. …
