Jurors See Police Video of Suspect's Statement

Jurors on Friday watched a video of capital murder suspect Demetrius "Joe" Foster telling homicide investigators his version of what happened the night victim Joshua Gardner was shot.

Foster, 28, is one of three people accused of killing Gardner, who was shot on Jan. 9, 2014 and died three weeks later.

Foster told investigators the same story during two interviews shortly after the shooting: that Gardner came to his home on 20th Street to show him some marijuana and that he was standing on the porch talking to his girlfriend on the phone when he heard someone say "Give it up, give it up" and then heard a gunshot.

He said that he went inside his home, told his mother that something had happened and called Gardner, who didn't answer.

"I swear to God, I do not know who shot Josh," he said. …
