DUMONT -- A lawsuit that Sgt. Joseph Rizza filed in 2013 against the Police Department and the Borough Council alleging that his civil rights were violated when he was passed over for a promotion is scheduled to go to trial Feb. 29 in state court in Hackensack, his attorney says.

Before a round of police promotions in October 2013 that saw nearly a third of the 32-member department assigned to higher ranks, Rizza was ranked last among four candidates, including one patrolman, seeking to become lieutenants, the lawsuit states. The three other officers were subsequently promoted, but Rizza, then a 27-year veteran of the department, was not.

Rizza alleges in the lawsuit that Chief Joseph Faulborn Jr. did not recommend him for a promotion because of Rizza's activities as a member of the police union. …
