West Milford, Newark Headed to Tax Court

WEST MILFORD -- Newark is getting a second stab at rebuffing the local government's argument for a tax-assessment increase on watershed lands.

Last year, the Passaic County Board of Taxation logged a decision raising the assessment for West Milford's largest taxpayer from $39.4 million to $61.5 million after arguments from both sides. More recently, however, the Tax Court of New Jersey ruled that the county tax board did not have the jurisdiction to decide on the township's 2015 appeal.

"So, the county tax board decision was set aside, and the township now has to start the litigation for the 2015 assessment in the Tax Court," Township Administrator Antoinette Battaglia said.

In addition to preparing for a repeat case against Newark, Battaglia said, West Milford is seeking to restore the validity of the valuation on Newark's conserved watershed holdings set by the county board in appeals court. …
