Former Lifeguard in Upper St. Clair Scheduled for Trials on Sex Assault Charges

The first trial for a former head lifeguard at the Upper St. Clair Recreation Center charged with sexual assault is scheduled for March 31.

Michael A. Kelly, 29, of Castle Shannon has two criminal cases pending, including charges of rape, involuntary deviate sexual intercourse and related counts stemming from 2011 through 2013.

In the first case, Mr. Kelly is accused of assaulting a teenage lifeguard he supervised. Bethel Park District Judge Ronald A. Arnoni dismissed charges of indecent assault, sexual assault and involuntary deviate sexual intercourse at a preliminary hearing in October, but the Allegheny County district attorney's office refiled them.

Defense attorney Charles Porter has filed a motion with Common Pleas Judge Jill E. Rangos to quash them prior to trial.

In that case, police said Mr. Kelly flirted with the alleged victim, who was hired at the rec center as a lifeguard at age 15 in 2011. On three different occasions, the teen said Mr. Kelly followed her into a storage room, closed the door, exposed himself and demanded a sex act. In addition, police said the teen went with him to his home where they would have sex.

In the second case, Mr. Kelly is accused of forcing a young woman with whom he had an on-and-off-again relationship to have sex with him. …
