An owner of a diagnostic laboratory was sentenced on Monday to nine months in federal prison for paying $28,000 in bribes to a doctor in exchange for referring patients to the lab for blood work.

"I cut you a break today," U.S. District Judge Madeline Cox Arleo told Phillip Biondello during a hearing in Newark, noting his struggles with alcohol and prescription drug abuse over the last several decades.

She urged him to use his time in prison to "get your act together" so that he can "get sober and get healthy" and start over when he is released.

In addition to a prison term below the two-year minimum term called for in his plea deal, the judge imposed a $4,000 fine.

Biondello, 49, of Basking Ridge, pleaded guilty in December to violating a federal anti-kickback statute and admitted paying bribes to a doctor between 2011 and 2013 for referring about $176,000 worth of patient blood samples to the lab for testing. …
