Is it any of Jack McMillin's business whether Denny Rickard has his files safeguarded against fire?

The answer likely will be decided by the Butler County Court of Common Pleas.

Rickard, the county sheriff, filed suit last week asking the court to settle a long-standing battle with McMillin, the county controller.

At the crux of it is a questionnaire with more than 70 queries that McMillin has been asking Rickard to complete for the past three years. McMillin contends the answers are a necessary part of the annual audit his office is supposed to be doing of the county's row offices, including the sheriff's.

Rickard counters that the questions go beyond the scope of a routine audit and that he shouldn't have to tell McMillin whether his accounting records are "neat and well maintained" or whether all employees take annual vacations -- or whether his records are safe in case of a fire.

The trouble began a few years ago when McMillin contended the sheriff's records for 1999 were too disorganized to audit completely. …
