Plea-Deal Delay in Countdown Case

HACKENSACK -- A plea deal for the alleged "Countdown Bandit" was not finalized Thursday as expected, as the attorneys involved in the case said they needed more time to negotiate a resolution.

Maria Rockfol, a senior assistant Bergen County prosecutor, told state Superior Court Judge Susan Steele that she was seeking an 18- year prison term for Marcelino Garcia, who has no prior arrests.

Garcia would have to serve 85 percent of that term, or a little over 15 years, before becoming eligible for parole, she said.

Jerry Elashmawy, the attorney representing Garcia, said he had recently come across additional discovery materials and that he needed more time to review the matter with his client.

"Judge, this is a youthful offender, no prior records whatsoever. …
