Court Costs Are Too High ; Letters, Comments and Emails

THE health of the British economy depends on the dynamism and innovations of our small and medium size enterprises.

But the Registry Trust, which operates the Register of Judgments, Orders and Fines for England and Wales on behalf of the Ministry of Justice, recently released some worrying figures; small and medium sized businesses (SMEs) have had to write off Pounds 5.8bn in debt in the last financial year.

This can in part be attributed to the dramatic increase in court fees introduced in March last year, when the fee to issue claims of over Pounds 10,000 was increased to five per cent of the value of the claim with a cap of Pounds 10,000 - representing an increase of nearly 600per cent for claims over Pounds 200,000.

The effect of these fee increases is to severely limit the ability of individuals and small business to recover money owed to them by deterring them from going to court when they have genuine claims. …
