Sexual Assault Lawsuit Settled at Booker Middle

SCHOOLS

SARASOTA -- The Sarasota County School Board is expected to approve a $175,000 settlement involving the sexual assault of a female student by a male student at Booker Middle School three years ago.

The incident occurred Aug. 20, 2013, in the media center after the only adult in the vicinity, a faculty librarian, left the room, according to the suit. The victim, referred to as D.Z. in the subsequent lawsuit, immediately reported the assault to the principal's office. The assailant, a minor, was charged with lewd or lascivious molestation. He confessed to the attack and was given pretrial intervention.

D.Z.'s attorney, Damian Mallard, argued the district failed to provide proper supervision that would have deterred such aggressive behavior.
