Judge Dismisses Complaint over Referendum Question

U.S. District Judge Robert D. Mariani on Friday dismissed a complaint against Pennsylvania Secretary of State Pedro A. Cortes that accused him of allowing a misleading question on the retirement ages of judges to appear on election ballots Nov. 8.

The complaint, filed by Richard Sprague, a member of the state Judicial Conduct Board, and Ronald Castille and Stephen Zappala Sr., former chief justices of the state Supreme Court, said Mr. Cortes "agreed to present the voters of the Commonwealth with a ballot question that was nearly identical to the question that the secretary had previously argued would mislead voters."

The question originally asked voters whether judges should have to retire "on the last day of the calendar year in which they attain the age of 75 years, instead of the current requirement that they be retired on the last day of the calendar year in which they attain the age of 70. …
