Opra Requests Subject to Open Records Law, State Court Rules

A state appeals court has ruled that document requests submitted under the state's Open Public Records Act are themselves public records and that government officials - including the governor's office - had incorrectly denied access to them in three cases.

The ruling, issued Friday, affirms a decision by state Superior Court Judge Mary Jacobson that a private citizen was entitled to copies of OPRA requests submitted by third parties to the governor's office for documents relating to the closure of traffic lanes on the George Washington Bridge. Beyond that case, brought by open- government activist Harry Scheeler, the ruling also pertains to two others where document requests brought to state agencies were denied on the same basis.
