Appellate Court Upholds Denial of Long Bar Pointe Marina

MANATEE COUNTY -- An appellate court on Friday upheld a lower court's rejection of a lawsuit filed against Manatee County over the proposed Long Bar Pointe development.

As Cargor Partners, developers Carlos Beruff and Larry Lieberman proposed a residential and commercial development on Sarasota Bay that would include a marina. Representatives of the fishing industry in Cortez and environmentalists spoke against the project in a contentious public hearing in 2013, insisting the marina and its channel would damage seagrasses and fisheries. The County Commission unanimously rejected the marina and channel as inconsistent with the county's Comprehensive Plan.

Cargor Partners sued, challenging the validity of the coastal element of that land-use policy document. The developers claimed the county violated their federal and state constitutional rights by depriving them of making use of their "private submerged land. …
