Airport Trust Announces New Policy for Operators

Fixed base operators will be required to pay their rent or move off the premises - after a second chance with a temporary perm it, according to a new policy announced Monday by the Oklahoma City Airport Trust.

"The time for compromise is over," said Don Bown, city manager and trust member.

The policy includes a provision for a revocable permit, which would allow the tenant to maintain residency on a temporary basis, as long as payments of one-and-a-half times the regular monthly lease amount are made.

Three of the five fixed base operators at Wiley Post and Will Rogers World Airports, are behind in lease payments for a total of $400,332, according to figures released by the department of airports accounting office.

Airport officials have exercised some leniency with operators, they say, because of the impact a declining oil market has had on the aviation industry. However, some accounts are as much as 120 days behind. Further indebtedness would only compound the problem, they said.

Under the revocable permit, if the tenant fails to make a payment, the airports department can order the tenant to vacate the premises immediately.

Conversely, if the account is brought into balance, the tenant could be reconsidered for a new lease with the airport.

The permit is "substantially identical" to the lease agreement with the operator, except for the immediate order to vacate, according to Bob Fuson, legal counsel for the trust.

- Catlin Aviation, whose lease at Will Rogers was terminated after a 30-day notice to pay its account in full expired April 9, still owes a total of $63,484. A 10-day notice to vacate the premise was up early this week.

However, according to the new policy, Catlin could contact city officials and, at the discretion of the airport staff, arrange for a revocable permit. …
