Opponents Request Delay in Fluid Disposal Minimum / 20 Cents per Barrel

Delay of a minimum charge for disposing of oilfield fluids was sought Thursday at the Oklahoma Corporation Commission by atto rneys for independent producers, drillers and at least one hauling company.

They oppose a 20 cent per barrel minimum charge to dispose of satwater and other drilling fluids recommended April 23 by Charles D. Dudley, hearing officer for the commission's transportation division.

Requests to intervene in the cause were filed by the Oklahoma Independent Petroleum Association (OIPA), Mid-Continent Oil & Gas Association, Ramsey Property Management, Arrow Tank Trucks and WarrenDrilling Co.

The commission was expected to be ready to issue an order Thursday adopting Dudley's opinion but the filings have put it off until at least next week. Hearing Officer Robert Goldfield said he will issue an opinion on whether the intervetions should be allowed by next Monday.

No witnesses who were solely oil and gas operators spoke at the original hearings last August, argued Cheri Wheeler, former deputy chief counsel for the commission's oil and gas division, now representing Ramsey, Arrow and the Oklahoma Independent Petroleum Association.

"These are the very people who are soley affected," she said, because the charge would be "passed through" by the carriers to operators.

Dudley's recommendation would force haulers to add 20 cents to hauling charges for unloading saltwater into disposal wells.

Also the corporate parent of some haulers who also own disposal wells charge minimal fees, as low as 1 cent per barrel, for dumping, giving them a definite competitive edge, according to testimony before the commission. …
