Henry E. McKenna, Plaintiff, vs James O'Donnell a/k/a Jim O'Donnell, Marcella Rueb, and the Heirs, Executors, Administrators, Devisees, Trustees and Assigns, Immediate and Remote, of Mary Margaret O'Donnell, Deceased, Defendants.

THE STATE OF OKLAHOMA TO: James J. O'Donnell, Marcella Rueb, and the Heirs, Executors, Administrators, Devisees, Trustees, and Assigns, Immediate and Remote, of Mary Margaret O'Donnell, Deceased.

You and each of you are hereby notified that Henry E. McKenna, as plaintiff, has filed in the District Court of Oklahoma County, Oklahoma, against James J. O'Donnell, Marcella Rueb, and the heirs, executors, administrators, devisees, trustees and assigns, immediate and remote, of Mary Margaret O'Donnell, deceased, alleging that Mary Maret O'Donnell, deceased, died seized and possessed of the following described real property:

All of Lots Twenty-Two (22) and Twenty-Three (23), Block Nineteen (19), Military Park Addition to Oklahoma City, Oklahoma;

that the plaintiff is the owner of said real property in actual and peaceable possession thereof; that the defendants, the unknown heirs, executors, administrators, devisees, trustees and assigns, immediate and remote, of Mary Margaret O'Donnell, deceased, claim some right, title or interest in and to said real property adverse to the plaintiff which constitutes a cloud on the plaintiff's title; that there has been no judicial determination of the heirship of said Mary Margaret O'Donnell, deceased; and praying judgment for plaintiff against the defendants, judicially determining the names and individual identity of each and all persons who took, or were entitled to take, said real property under the intestate laws of succession in force at the time of the death of the deceased, and the proportion or part therefor that each took, or was entitled to take, as an heir of Mary Margaret O'Donnell, deceased; that the unknown heirs, executors, administrators, devisees, trustees and assigns, immediate and remote, of Mary Margaret O'Donnell, deceased, be required to show what right, title or interest, if any, that they now have in and to said real property, adverse to the right, title or interest of the plaintiff; that they be adjudged to have no right, title or interest or estate therein, and that the title of the plaintiff in and to said real property be quieted against the heirs, executors, administrators, devisees, trustees and assigns, immediate and remote, of Mary Margaret O'Donnell, deceased, and the defendants be perpetually barred and enjoined from setting up or asserting any right, title or interest in said real property. …
