Massey Expansion Delayed Pending Advertising Review / Motorcycle Dealer Denied; 6 Dealers Ok'd

Expansion of Ray Massey's automobile dealerships in Edmond have been delayed until June 14 pending a review of current Massey newspaper advertising, the Oklahoma Motor Vehicle Commission ruled Tuesday.

An application by Harley-Davidson Inc. of Milwaukee to open a second new motorcycle dealership in the metropolitan area also was rejected.

But six other applications for new vehicle dealers licenses were approved by the commission, including Dave Markley Jeep-Eagle Inc. in Oklahoma City, Williams Acura of Norman and Fred Jones Mitsubishi, also of Norman.

Massey, who has appealed an earlier commission ruling alleging false and misleading advertising, had applied for a dealership license to sell Mitsubishi autos. Massey holds a license to sell Mitsubishi trucks in the Ray Massey Edmond Auto Park near the intersection of Broadway Extension and E. Memorial Rd.

Other dealerships in that location include Ray Massey Honda and Edmond Nissan.

The commission deferred a decision on the application until Executive Director Charles Eckhardt completes a review of the of advertising by the three existing dealerships between April 13 and May 9.

The bid by Harley-Davidson Inc. was protested by Elsie Kelley, president of Par's Custom Cycle Inc. dba Harley-Davison World, 2421 SW 29th St.

Kelley said the proposed location was eight miles from her dealership. Commission rules prohibit establishment of intrabrand competition within a 15-mile radius of an existing dealership if a protest is filed.

The intended dealership, Bryan Harley-Davidson Inc., 2624 N. Moore Ave. in Moore, is an authorized parts and service representative for the motorcycles and sells used vehicles, according to owners Charla and Roger Bryan.

In her protest, Kelley said advertising by the Bryans indicates the company is an authorized full-line dealer, a charge the Bryans denied.

However, the commission admonished the dealership to be more circumspect in its advertising. …
