NOTICE OF PROPOSED RULEMAKING

Cause No. RM 000,034

Before the Corporation Commission of the State of Oklahoma.

In the Matter of the Corporation Commission Amending, Establishing, and Deleting Certain Oil and Gas Rules.

Pursuant to 52 0.S. 1981 \s97, 101, 139 and 141, the Corporation Commission of the State of Oklahoma proposed to establish and amend the Oklahoma Corporation Commission Oil and Gas Rules (OCC-OGR) and the Rules of Practice (OCCRP) as follows:

Proposal No.1: Ru1e 1-101 Definitions.

Proposal No.1 would amend the definition of waste oil in OCC-OGR Rule 1-101 to include oil retained on cutting from drilling with oil based mud. The purpose of this proposal is to clarify the existing rule to permit County Commissioner to use such cuttings as road material as part of the road oiling program under OCC-OGR Rule 3-500.

Proposal No. 2: Rule 3-110.1 Use of Non-Commercial Pits.

Proposal No. 2 would clarify OCC-

OGR Rule 3-110.lE(2) to specify that trenching of the contents of a lined non-commercial pit is prohibited. This proposal seeks to prevent possible groundwater contamination resulting from destruction of the liner during trenching of the pit contents.

Proposal No.3: Rule 3-110.8 Noncommercial Disposal Well Surface Facilities.

Proposal No. 3 would establish a new rule to be known as OCC-OGR Rule 3-110.8 to establish requirements for surface facilities for noncommercial salt water disposal wells. The focus of this proposal is on spill prevention and control where the operator unloads saltwater by truck.

Proposal No. 4: Rule 3-305 Testing and Monitoring Requirenents of Enhanced Recovery Injection Wells and Disposal Wells.

Proposal No. 4 would amend the provisions of OCC-OGR Rule 3-305 related to zero pressure monitoring of the casing tubing annulus of disposal and enhanced recovery injection wells. Presently, the U.S. Environnental Protection Agency is directing the Commission to require a positive pressure on said annulus to determine the mechanical integrity of such wells in the absence of a periodic pressure test. So, this proposal seeks to amend the existing rule to comply with changes in the federal program.

Proposal No. 5: Rule 3-700 Disposition of Oil Field Waste (Reference Chart).

Proposal No. 5 would establish a new rule to be codified as OCC-OGR Rule 3-700. This proposal outlines disposal options for proper disposal of oilfield wastes.

Proposal No. 6: Rule 8-8.2 Procedure for Amendments to Existing Orders Authorizing Injection for Enhanced Recovery, Saltwater Disposal, or LPG Storage Wells. …
