Consideration Postponed on Tulsa Track Application

The Oklahoma Horse Racing Commission postponed further consideration of Will Rogers Downs' application for 1990 races dates after track managers failed to submit their required $19,000 application fee during a public hearing on the application Wednesday.

Will Rogers Downs General Manager Bill Poulos submitted a $19,000 check written on The Bank of Inola to the commission Wednesday, but a call to bank vice-president Carolyn Penner proved the funds were not available in the account at that time.

"I asked her if those funds were good," said Gordon Hare, executive director of the horse racing commission, "but she said the funds were not in the account. . .but could be set aside for the purpose of clearing the check if a deposit was made."

Penner added that she had received a call from W.S. Atherton, a major stock holder in the Will Rogers Jockey and Polo Club, and that the necessary funds would be deposited before the end of the day.

Commissioner James Kirk of Oklahoma City made a motion to postpone any further action until a cashier's check or certified check were received.

Commissioner T.J. Henry of Lawton said, however, that he was concerned over accepting any application fee from Will Rogers Downs when the law states that Will Rogers Downs is ineligible for a license.

"The statue says that once an applicant is denied a license they are ineligible to reapply," Henry said.

Will Rogers managers had applied for 1989 race dates, but were denied by the commission, which cited the track as financially unstable.

Poulos claimed the mix-up on the funds came about because he didn't think he was required to pay the funds due to the track being in Chapter 11 bankruptcy. …
