Rather than sue the Oklahoma Horse Racing Commission, Remington Park owners and managers are considering petitioning the commission for a rehearing on the commission's allocation of 1990 race dates.

Remington Park officials were very irrate that the commission granted the Tulsa State and Tulsa County fairs 19 consecutive pari-mutuel dates at the expense of Remington Park and Blue Ribbon Downs in Sallisaw. The commission moved Remington Park's 1990 fall meet back from Sept. 21 to Sept. 28 and made Blue Ribbon Downs shut down Sept. 27-30, so the fairs could run with out any competition from other pari-mutuel tracks. The combined fairs are planned for Sept. 8-30.

"The best approach for all involved is to petition for a rehearing," said David Vance, Remington Park's vice-president and general manager. "The worst case would be to go the legal avenues.

"We've been wronged and we feel very strongly about it and we're not about to ignore it."

Don't expect any action on the matter for at least a month, however. According to the administrative procedures act, Remington Park cannot petition for a rehearing until it has "unconditionally accepted" the commission's 1990 license with the dates as approved by the commission, said Gordon Hare, the commission's executive director.

Last Thursday's action on race dates was only preliminary. Final approval of the licenses will be during September's regular monthly meeting.

Bill Liberty, Blue Ribbon's general manager, said his legal counsel is looking also into the matter.

"The first thing we need is a legal interpretation of just what makes up a fair meet," Liberty said. . .

Full House There was some question if there would be enough horses for Remington Park's fall meet because it was such a shortie - 50-days - compared to the 70-day season last fall.

To quote a popular song, "Don't Worry - Be Happy." More than 3,800 horses are vying for Remington Park's 1,216 stalls. …
