ORDINANCE NO. 19,936

AN ORDINANCE RELATING TO SPECIAL EXCEPTION REGULATIONS FOR COMMUNICATION TOWERS IN THE C-HC HIGHWAY COMMERCIAL DISTRICT; AMENDING SECTION 59-6200.2 H.(6) OF ARTICLE VI OF CHAPTER 59 OF THE OKLAHOMA CITY MUNICIPAL CODE, 1980, BY ESTABLISHING THE SPECIAL EXCEPTION REGULATIONS FOR THE COMMUNICATIONS SERVICES: TOWERS USE UNIT IN THE C-HC ZONING DISTRICT; AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OKLAHOMA CITY:

Section 1. That Section 59-6200.2 H. (6) of Article VI of Chapter 59 of the Oklahoma City Municipal Code, 1980, is amended to read as follows:

6200.2 Special Exception Uses:

H.Uses Permitted in a Specific Zoning District Upon Grant of a Special Exception. The Board of Adjustment may grant a special exception for uses specifically authorized in each zoning district under the category "special exception uses." In addition to the use standards listed below all said uses shall also conform to the specific standards listed in Chapter 59 before approval may be granted:

(6)Communications Services: Towers (2416.2):

(a)Eligible in AA, O-2, C-3, C-4, C-CBD, C-HC, I-1, I-2 and I-3.

(b)The following shall be required to obtain a special exception:

1.Any tower anchored to the ground which is proposed to extend to a height of over fifty (50) feet.

2.Any tower attached to a building which is proposed to reach a height over twenty (20) feet above the roof line of the building.

(c)Standards for Ground Anchored Towers:

1.Towers and antennas shall be located on a site so as to provide a minimum distance equal to one hundred ten (110) percent of the height of the tower from all property lines; provided however, that the Board may modify this requirement where tower design will assure that a collapsing tower will fall within a smaller area. …
