Applicant: Helmerich Payne, Inc. Relief Sought: Well Location Exception. Legal Description: Section 3, Township 2 North, Range 11 East, Coal County, Oklahoma.

STATE OF OKLAHOMA: To all interested persons in Section 3, T2N, R11E, Coal County, Oklahoma (hereinafter "Subject Lands") and offsetting lands in particular to the following persons, their known and unknown heirs, executors, administrators, devisees, trustees, assigns and successors, immediate and remote: Arkla Exploration Company now Seagull Mid-South Inc. and Samson Resources Company.

NOTICE IS HEREBY GIVEN that the Applicant in this cause is requesting that the Oklahoma Corporation Commission (hereinafter "Commission") issue an order providing as follows for the Cromwell Sand, Bromide Sand, McLish Sand, Oil Creek Sand, Hartshorne Sand, Atoka Sand, Joins, Arbuckle, Booch and Wapanucka Lime common sources of supply (hereinafter "Subject Common Sources Of Supply") underlying the Subject Lands:

(a) Authorizing an off-pattern well to be drilled, completed, produced and operated without penalty upon allowable production at a location no closer than 660 feet from the north line and 1320 feet from the east line of said Section 3 for the following drilling and spacing unit underlying and comprised of the Subject Lands: 640-acre unit for gas and gas condensate for the Cromwell Sand, Bromide Sand, McLish Sand, Oil Creek Sand, Atoka Sand, Joins, Arbuckle and Booch by Order No. 106638; 640-acre units for gas and gas condensate for the Hartshorne Sand by Order No. 106947; 640-acre units for gas for the Wapanucka Lime by Order No. 362222. Under the above-referenced Orders, the Commission established the permitted well location to be at any point within the unit no closer than 1320 feet from the outside boundary thereof. Applicant's proposed location is not a permitted well location under said Orders; and

(b) Designating Applicant or some other person as operator of the off-pattern well;

(c) Granting such other relief as is merited by the evidence and is just and equitable. …
