ORDINANCE NO. 19,962

AN ORDINANCE RELATING TO PEDDLERS, SOLICITORS AND OUTDOOR SELLERS; AMENDING CHAPTER 39, ARTICLE II, DIVI-SION 2, SECTION 39-34 OF THE OKLAHOMA CITY MUNICIPAL CODE, 1980, RELATING TO ISSUANCE OR DENIAL OF LICENSES; AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE COUN-CIL OF THE CITY OF OKLAHOMA CITY:

Section 1. That Chapter 39, Article II, Division 2, Section 39-34 of the Oklahoma City Municipal Code, 1980, is hereby amended to read as follows:

Section 39-34. Review and investigation; issuance or denial.

(a)Upon receipt of an application for a license as required by Section 39-31 of this article, the Supervisor of Licenses shall submit one (1) copy thereof to the Chief of Police for review. The Chief of Police shall note thereon any relevant information which appears in the official records in his charge concerning any conviction of the applicant for the offenses specified in subsection e (1) of this section.

(b)The Supervisor of Licenses shall cause such other investigation or inquiry concerning the applicant as deemed necessary to determine whether the application is in compliance with the terms and conditions of this article and other applicable provisions of this Code.

(c)Upon completion of the necessary investigation as provided for by this section, the Supervisor of Licenses shall review the application to ensure:

(1)That the applicant or his employer is a vendor registered with the Oklahoma Tax Commission for the payment of sales tax, or that he has otherwise demonstrated that sales tax has been or is being paid on the items sold, or that he or his employer is exempt from payment of such tax;

(2)That the applicant or his employer is aware of his responsibility to collect and pay sales tax, unless tax exempt;

(3)That the site chosen for any fixed outdoor business location is appropriately zoned for such a land use, is otherwise in full compliance with Chapter 59 of the Code, and that the said location does not extend onto any portion of the public rights-ofway;

(4)That the applicant's character or business responsibility is not "unsatisfactory" (as defined in subsection (e) of this section;

(5)That the applicant's proposed signs and locations therefor comply with all of the provisions of Article III, Chapter 3 of the Oklahoma City Municipal Code 1980; and

(6)That the application otherwise complies with all of the provisions of the Oklahoma City Municipal Code, 1980.

(d)Within seven (7) business days after receipt of the application, the Supervisor of Licenses shall either approve or disapprove of the application. Grounds for disapproval shall be the following:

(1)A finding that the application is incomplete;

(2)Non-payment of the application and investigation fee;

(3)Failure of the applicant to verify that he or she, or his/her employer, is a vendor registered with the Oklahoma Tax Commission for the payment of sales tax; or that sales tax has been or is being paid on the items sold; or that he or she, or his/her employer, is otherwise exempt from payment of sales tax;

(4)A finding that the site chosen for a fixed outdoor business location is not properly zoned for the proposed land use or that said site extends onto a portion of the public rights-of-way;

(5)A finding that the applicant's proposed signs and locations therefor are not in compliance with Article III of Chapter 3 of the Oklahoma City Municipal Code, 1980;

(6)A finding that the application is not in conformance with other applicable provisions of Chapter 59 or other provisions of the Oklahoma City Municipal Code, 1980; or

(7)A finding that the applicant's character or business responsibility is "unsatisfactory" (as defined in Subsection (e) of this section). …
