STATE OF OKLAHOMA: To all persons, owners, producers, operators, purchasers and takers of oil and gas and all other interested persons, particularly in Beaver County, Oklahoma, and more particularly to Peter M. Gross, Alfred and Peter M. Gross, Trustees of Jane Gross Trust, Richard W. Pettigrew, Daniel T. O'Shea 1978 Trust, Russell James Walker and James Powell Walker, Trustees, John J. Gergurish, Kenneth and Vena Mae West Trust, Thomas J. Sweeney, Tom G. Robinson and Curtis H. Whitson, if living, and if deceased, then their known and unknown heirs, devisees, executors, successors, administrators, trustees and assigns and Aexco Petroleum, Inc., R.K.K. Production, Inc., Intersearch Corporation, Kansas Natural Gas, Inc., Vintage-P Acquisition Limited Partnership, Miracle Production, Inc., Vintage Petroleum, Inc., Zenith Drilling Corporation and TCG Limited Partnership, their successors, trustees and assigns.

NOTICE IS HEREBY GIVEN that Applicant in this cause is requesting that the Commission pool and adjudicate the rights and equities of oil and gas owners and designate the Applicant or some other party as operator pursuant to Title 52, O.S., Section 87.1 in the Upper Morrow Formation (Order No. 44099), the Lower Morrow Formation (Order No. 44464), the Chester Formation (Order No. 127930), the Herington-Krider, Council Grove, Virgilian Series, Lansing-Kansas City, Marmaton, Cherokee, Atoka, St. Genevieve and St. Louis Formations (by Order to be entered in Cause CD No. 930 170265), underlying Section 20-6N-22ECM, Beaver County, Oklahoma.

NOTICE IS FURTHER GIVEN that the Applicant in this cause is requesting the following special relief:

(a) Designation of the Applicant or some other party as operator of the unit well; and,

(b) The Applicant shall request at the hearing that the order provide that any owner electing an alternative to participation in the well drilled thereunder shall be deemed to have relinquished all of its working interest and right to drill in the unit and common sources of supply named herein as to such well and any wells drilled subsequent thereto; and

(c) The Applicant may propose that the order to issue in this cause provide a method for proposal of subsequent wells and for response to that proposal by owners who elect to participate in the initial well. …
