NOTICE OF SALE

PURSUANT TO OKLAHOMA POWER OF SALE MORTGAGE FORECLOSURE ACT NOTICE IS HEREBY GIVEN TO: Mr. Daniel Rodriguez, 637 Kings Manor, Oklahoma City, OK 73160-2532; Ms. Renee D. Byce, 1500 S.W. 51st, Oklahoma City, OK 73119 that, on the 28th day of February, 1997, at 10:00 o'clock a.m., at 1500 S.W. 51st Street, in the City of Oklahoma City, County of Oklahoma, State of Oklahoma, the undersigned Mortgagee will offer for sale and sell for cash, or such other terms as the undersigned Mortgagee may find acceptable, to the highest and best bidder all that certain real estate in Oklahoma County, State of Oklahoma, legally described, to-wit: Lot One (1) Block Twenty Two (22) STANFORD HOMES ADDITION to Oklahoma City, Oklahoma County, Oklahoma, according to the recorded plat thereof the street address of which is 1500 S.W. 51st Street, Oklahoma City, OK 73119. Sale will be made pursuant to 46 O.S. ss. 45 of the Oklahoma Power of Sale Mortgage Foreclosure act and follows the mailing of a notice of intention to foreclose to Mortgagor, as reflected in the Affidavit of Mortgagee, attached hereto as Exhibit "B". The aforesaid Notice of Intent to Foreclosure described the events of breach and default occurring under the terms of that certain Mortgage and Security Agreement dated April 29, 1994, executed by Daniel Rodriguez, in favor of Bill O. Langston and Anne H. Langson, (and now held by Mortgagee pursuant to Assignment) recorded in Book 6878, Page 1152 in the office of the County Clerk of Oklahoma County, Oklahoma, to-wit: (a) the failure of mortgagor to make the payments of principal and interest due August 1, 1996, and on each and every month thereafter. The foregoing events of default were not cured in accordance with the terms and provisions of the mortgage within thirty-five (35) days from the date the aforesaid Notice of Intent to Foreclose was mailed to Mortgagor. The undersigned mortgagee has elected to accelerate the indebtedness secured by the Mortgage and has elected to foreclose the lien of the mortgage pursuant to the power of sale contained therein, on the date and time and at the place stated in the first paragraph herein. …
