NOTICE OF

PROPOSED RULEMAKING Cause RM No. 970 000013 Before the Corporation Commission of the State of Oklahoma. In the Matter of a Rulemaking by the Oklahoma Corporation Commission amending certain rules of practice, OAC 165:5. NOTICE IS HEREBY GIVEN that the Oklahoma Corporation Commission ("Commission") proposes to amend Chapter 5 of Title 165 of the Oklahoma Administrative Code ("OAC 165:5"), the Commission's Rules of Practice. The following changes to OAC 165:5 are proposed. The amendment to OAC 165:5-1-4 adds the mailing address for the Oklahoma City office. In OAC 165-5-3-1, the language pertaining to underground and aboveground storage tank fees is amended to state that a facility that has both petroleum and hazardous substance underground storage tanks will be considered one facility and that fees shall be paid yearly for tanks currently in use. The definition of "public utility" in OAC 165:5-3-21 is amended to comply with the statute. The amendment to OAC 165:5-3-22 adds fee allocation for resellers and operator service providers. The amendment to OAC 165:5-5-1 adds the following dockets: Consumer Services (CS); Oil and Gas Citation (OGC); and Fuel Citation (FC). The amendment to OAC 165:5-7-6 modifies the language addressing notice of hearing required for drilling and spacing unit establishment or modification. In OAC 165:5-7-9, the notice of hearing required for a well location exception is modified. The amendment to OAC 165:5-7-10 deletes the requirement for notice of hearing of an increased density well application to each identifiable purchaser of gas from the initial well. The addition of a new subsection to OAC 165:5-7-27 provides for unit-wide UIC permits that allow the operators and the UIC Department to determine permit conditions throughout a new waterflood area. The amendment to OAC 165:5-7-53 amends the notice requirements for the certificate of convenience and necessity for telephone lines to comply with statute. In OAC 165:5-7-57(a), a reference to 17 O.S. Section 158.50 is added. The amendment to OAC 165:5-7-61(f) replaces the word "responsible" with the word "responsive." Amendments to OAC 165:5-7-65, the section addressing applications relating to intrastate motor carrier authority and licenses, modify the section to conform with applicable law. …
