Illinois Prison Guard Accused in Federal Court of Assaulting Inmate

BENTON, Ill. * A correctional officer at the Pinckneyville Correctional Center in Perry County was charged in federal court here Thursday with assaulting an inmate in 2016.

Charging documents say Dustin A. Fleming choked, punched, kneed and/or kicked an inmate on Oct. 15, 2016 "without legal justification," injuring the man.

Fleming faces a charge of depriving the inmate of his rights under color of law. He's next due in court July 18. No lawyer is listed, and Fleming could not be reached for comment.

The inmate is identified only by initials, but those initials match a man who sued Fleming in federal court June 5. Martell Franklin's lawsuit says that he and Fleming got into a "verbal altercation" on Oct. 15, 2016. The suit says Franklin was transferred in handcuffs to the prison segregation unit and was then attacked by Fleming while two other officers "stood by and watched. …
