PATERSON — A departmental review determined that a Passaic County Sheriff's Officer who conducted a controversial search of a minivan parked in Paterson in July should not face disciplinary action, authorities announced Thursday.

The officer, John Tolerico, was responding to "credible information" about a gun in the area, said William Maer, spokesman for the sheriff's office. The incident was reviewed by the sheriff's Internal Affairs division, Maer said.

"The detective was justified in searching the vehicle because of the community caretaking type of exigent circumstance, which arises in situations where the safety of law enforcement officers or members of the general public is in danger," said Maer.

Tolerico did not find a gun in the minivan during his search, Maer said. No arrests were made or summonses issued in the case, he added. …
