Most people are surprised that our democratic model is no longer working. John Paul Stevens and 1,400 law professors, among others, have questioned this Supreme Court nomination, both for the temperament and honesty of the nominee and the process by which he was vetted. The model worked in the case of Robert Bork; he was rejected. The model worked for Clarence Thomas; he was accepted. Regardless of your thoughts about outcomes, there were proper FBI background checks.

Mitch McConnell rails vehemently against the Democrats for trying to block this nomination, but he did just that two years ago with Barack Obama's nomination. Put simply, when it was Mr. Obama's turn, Mr. McConnell didn't like it and cherry-picked the rules. Merrick Garland never even got a hearing. It was playground politics and bullying with extreme consequences, to the dismay of those who expected a fair hearing. …
