INTRODUCTORY NOTE: On 6 April 1994, the President of Rwanda and the President of Burundi were killed when their plane, near the airport of Kigali, was hit by a rocket. A systematic killing of Tutsis and Hutu moderates in Rwanda amounting to genocide began immediately afterwards. The Security Council, by Resolution 935 (1994) of 1 July 1994, established an impartial commission of experts with a view to providing it with the evidence of grave violations of international humanitarian law including acts of genocide. Based on the preliminary report of this commission, the Security Council, on 8 November 1994, acting under Chapter VII of the Charter, adopted the present resolution establishing the International Tribunal for Rwanda. The Statute of the Tribunal, annexed to the Resolution, is to a large extent identical to that of the Yugoslav Tribunal (No. 109). The conflict in Rwanda being of a non-international character, the competence of the Tribunal includes, apart from genocide and crimes against humanity, violations of Article 3 common to the Geneva Conventions (Nos. 49–52) and of Additional Protocol II (No. 57) (see Article 4 of the Statute).
