DPWH Adopts Right-of-Way Payment Policy

The Department of Public Works and Highways (DPWH) under Secretary Simeon A. Datumanong has adopted a ''first in, first out'' procedure in the payment of right-of-way claims for private properties being used for government projects to avoid discrimination, insure fairness, and prevent injustice.
This was disclosed yesterday by DPWH Senior Executive Assistant Abogantao Kenis who said other measures were set in motion by Datumanong to expedite the implementation of DPWH projects and the settlement of right-ofway claims.
Kenis said that last March 19, Datumanong issued Department Order No. 47, Series of 2001, delegating to the regional director of DPWH Region 12 (Central Mindanao) the authority to approve claims/deeds of sale involving private property taken or acquired for right-ofway purpose up to P20 million per claim or deed of sale, subject to availability of funds and strict compliance to documentary requirements as prescribed under existing laws, rules, and regulations on the matter.
He said that despite Datumanong's efforts to adhere strictly to the "first in, first out" procedure in the payment of right-of-way claims, some people, particularly those from Maguindanao, still criticize him and give political color to his actuations. …
