Ian Farrell and Chelsea Marx, The Fallacy of Choice: The Destructive Effect of School Vouchers on Children with Disabilities, 67 AM. U. L. Rev. 1797 (2018). This article outlines the negative effects school voucher programs have on students with disabilities. The authors argue that schools participating in voucher programs could discriminate against disabled students by refusing to admit them, and that the voucher program causes funding flight that leaves public schools unable to accommodate the needs of disabled students. The article further explores the rights and protections disabled students have to give up in order to participate in voucher programs. The article concludes by encouraging disability advocates to resist the adoption of voucher programs by the federal government, and argues that the programs are discriminatory and violate the Equal Protection Clause in hopes that federal courts will rule that the voucher programs are unconstitutional.
