Physicians ought to act ethically in caring for their patients, but a medical ethics resulting from the physician having a "good day" or being reluctantly resigned to the vagaries of the liability lottery is morally weak and structurally unstable. I have tried in these pages to assist physicians, other health care providers, attorneys, and policy- makers to more knowledgeably appreciate--the better to constructively reconcile--the real and imagined tensions between fear of liability and defensive medicine, on one hand, and ethical medical practice on the other. It is my hope that a practice of medical ethics built on such a foundation and that addresses and resolves those tensions--a morally sincere and structurally enduring foundation--will inspire a medical ethics more worthy of the name for physicians, their patients, and society.
